Raid Action
Either Administrative or Criminal Case is initiated against a trader found dealing with counterfeit products, an official complaint on behalf of brand owners is filed with the respective authorities in order to proceed with a raid action to seize the counterfeit products in the trader’s possession. As the seizure operation concludes, other procedural steps are conducted till the case reaches the court. Until the goods are destroyed, our role is vital to our clients to ensure that the case is followed through and they obtain a favorable outcome.
Market Sweep Raids
Market Sweep Raids are having its main purpose of sending a strong message within the market that brand owners are keen to taking action against illegal exploiters of their Intellectual Property Rights. This also means to protect consumers from purchasing counterfeit products and being tricked by the counterfeiters.
Such raids are usually conducted against a minimum of three traders (usually retailers) simultaneously. These traders are picked to be within the same vicinity or among a couple of the biggest markets for the same type of products.
Customs Recordation & Seizures
Customs authorities are the first line of defense that acts as a barrier to prevent counterfeits from entering the country. One of the steps we advise our clients to take is to conduct a Customs Recordation to have their trademarks well protected by the Customs authorities whenever there is a shipment carrying goods into the country.
Whenever a shipment is stopped and inspected, in case any brand is suspected to be counterfeit, the Customs authorities would send us a notification to consult on the nature of goods. Once a confirmation is made by the client, we could take necessary actions as we or the client sees fit.
Brand Awareness Training
An essential brand protection strategy we consider is Brand Awareness Training for Intellectual Property Enforcement Authorities. It is an annual project we do to educate authorities on how to distinguish genuine from the counterfeit products of certain trademarks. Herein, we also share client expectations on how they wish to enforce their brand protection strategies.
It is a practice we have successfully executed for many years and we have witnessed the fruits of such activities in terms of the increase in number of seizures, as well as the authorities becoming encouraged in the execution of their enforcement activities.
