Kuwait Limits Power of Attorney Validity Under New Decree

KUWAIT — The Ministry of Justice has issued Ministerial Decree No. 147/2025 (published November 2, 2025) amending the Notarization Law (Law No. 10 of 2020).

What’s changed:

  • POAs are now capped at a maximum of five (5) years, unless a shorter term is stated or the POA is terminated earlier.
  • Existing “unlimited” POAs remain valid for two (2) years from November 2, 2025—i.e., until November 2, 2027—unless otherwise ended sooner.
  • Exclusions: Commercial agency contracts and other cases the Ministry of Justice may exempt.

Why it matters: The reform enhances legal certainty around document validity and supports Kuwait’s move toward modernized, including digital/remote, notarization procedures.
