The Aden Trademarks Office has introduced a new technical requirement mandating that all Powers of Attorney be attested by the Yemeni Ministry of Foreign Affairs (MOFA) prior to filing trademark applications or undertaking any post-registration actions.
This change brings Aden’s practice in line with the longstanding procedures already enforced by the Trademarks Office in Sana’a.
Single Attestation Valid for Both Offices: A single MOFA-attested POA will be accepted for use in trademark matters before both the Sana’a and Aden Trademark Offices.
The attestation requirement is specific to POAs and does not currently extend to other intellectual property documents, such as Deeds of Assignment or Recordal Certificates.
POAs must be locally attested by the Yemeni MOFA within one year from the date of legalization by Yemeni embassies abroad. Failure to complete local attestation within this period will result in MOFA refusing to legalize the document, necessitating the issuance of a new POA.
