The Trademark Office in Yemen (Aden) has introduced new procedural requirements for trademark applications in Class 5, which covers pharmaceuticals and medical supplies.
Under the updated practice, applications in Class 5 will only be accepted if accompanied by an official declaration confirming that the trademark is being filed for protection purposes only and will not be used within Yemen. This declaration must be issued by the Legal Department of the Ministry of Industry and Trade in Aden.
Importantly, this declaration is a procedural prerequisite for registration and does not grant authorization to use the mark in the local market. Any commercial use of pharmaceutical or medical trademarks in Yemen remains subject to prior approval from the Supreme Authority for Medicines and Medical Supplies.
Previously, the Trademark Office required a license from the Supreme Authority before accepting Class 5 filings. Under the new procedure, the Office is now enforcing stricter compliance—no application in this class will proceed to examination without the required declaration.
